Intellectual property (IP) is a property that arises from human intelligence and a product created by humans. The term Intellectual property referring to a brand, invention, design or another kind of invention/creation, which a person or any entity has legal rights over. 

 

General types of Intellectual Properties

Copyright It is a right which gives protection to the inimitable expression of Ideas. this protects written or published works such as books, songs, films, web content and artistic works. The Indian Copy Rights Act, 1957 protects the copyrights system in India. The Act has been amended five times since then, i.e., in 1983, 1984, 1992, 1994, 1999 and 2012.

Patents – A patent describes an invention for which the inventor claims the exclusive rights. A registered patent protects commercial inventions, for example, a new product or process. Patents are also used to protect newly engineered plant species or strains, as well. The term patent has generally 20 years from the date of filing for patent rights for all creations/inventions.

Trade-marks – this protects words, phrases, symbols, sounds, logos, smells and color schemes that distinguish your products and services from those of your competitors. Trademarks are often considered assets that describe or otherwise identify the source of underlying products or services that a company provides. India’s trade-mark laws consist of the Trademarks Act 1999 and the Trade Marks Rules of 2002 and 2017.

Designs – this protects designs, such as drawings or computer models. The designs are controlled thru the Designs Act 2000 and the Design Rules 2001. Designs are valid for a maximum of ten years, renewable for a further five years.
